This function area is only available for use by residents and their guests; and short-term occupants of the building. 

In addition, this area is not to be used for any commercial purpose whatsoever unless permission is given by the Body Corporate.

Terms and Conditions:
The Body Corporate require this form to be completed and signed when residents and short-term occupants of the building request to book any area on Level 7 for a function or activity.

The areas to be booked are specific e.g. lounge only, theatre only or lounge and theatre. **

Please note that all of these areas are not available when Body Corporate meetings are scheduled or the Body Corporate claims specific dates in the calendar.

The Building Manager or representative is authorised to approve non-commercial functions as follows:


Residents and their guests (maximum of 15 people)
Short-term occupants (maximum of 15 people) provided they are
also Short-term occupants or residents.

A Resident is a person who an owner of a Lot in The Aurora Tower or a person(s) who have a residential lease of a Lot in the Aurora Tower with a term of 6 months or more. A guest is a guest of the Lot owner lessee as stated herein.


A Short-term occupant is a person who occupies a Lot under a lease, fee or other arrangement with a term of less than 6 months.


The Resident or Short term occupant who arranges the use of and pays the deposit will be referred to as the “Host’.


Only the Body Corporate may authorise other functions for residents and their guests and short-term occupants as follows:


Any commercial functions
Miscellaneous functions/gatherings
Functions in excess of 15 people (maximum allowable in lounge area is 30 people and maximum allowable in theatre area is 16 people)


Note : A corporate or business or government group who may be staying in the building and who requests the use of the Entertainment Area will be considered a commercial purpose.

Deposit/Possible Extra Charges:
There is no fee payable for the general use of lounge or theatre facilities on Level 7, however a deposit is required by any resident or short-term guest as follows:

$350.00 for up to 15 people
$1,000 for 16 to 30 people


This deposit is to be paid in cash or by credit card at the time of confirmation of the booking and in advance of the event. An appropriate receipt will be issued immediately upon payment by the Building Manager. Within 7 days after the event the deposit less deduction for any damage and or cleaning fees will be refunded to the Host. It is the sole discretion of the Building Manager and or the Body Corporate as the case maybe to determine what part of the deposit is not to be refunded. The host will be given copies of invoices for any extra cleaning or damage repairs.

A minimum cleaning fee of $200.00 will apply if the Host has not properly cleaned the area including removal of all stains, marks and smells best possible.

Any damage to common property i.e. lifts, foyers, corridors, safety equipment etc. attributed to the function will be charged to the host. Such charges will be calculated at the discretion of the Building Manager in conjunction with the Body Corporate.

Should the Fire Brigade be required to attend due to a resident or guest initiating a false alarm, the cost of the Fire Brigade attendance will be passed on to the host. This fee is set at $900.00.

If a representative of the Building Manager and/or Body Corporate has to attend to any situation regarding the function, a callout fee of $100.00 will be charged plus a further charge of $100.00 per hour, or part thereof, for time taken to attend to the callout matter. Any such callout will be documented by the representative of the Building Manager/Body Corporate. This does not include a routine or usual matter of inspection or similar usual duties that the Building Manager would do as a normal part of the job of managing the building in a proper manner.
Indemnity:
The Host of a function indemnifies the Building Manager and the Body Corporate against any claim, action, damage, loss, liability, cost, charge, expense, outgoing or payment which arises as a result of the use of the recreation facilities by the Host and their guests, and any costs which the Building Management and/or Body Corporate incurs as a result of the function.

The deposit may be insufficient to cover the loss suffered and the Body Corporate will be entitled to claim the full amount of loss from the Host.
Arrangement for Furniture / Supplies:
All items such as furniture, crockery, entertainment equipment and external catering supplies must be brought into the building through the loading bay or carpark and not through the building entry foyers.

The Building Manager must be informed if the loading bay is to be used and this bay must be pre-booked accordingly.

Rubbish:
All rubbish from the function is to be disposed of via the garbage chute on Level 7 or in the rubbish bins and/or recycling bins on Level 1.

No rubbish is to be left on Level 7, either in the lounge or theatre after the function, otherwise a cleaning charge will apply.

Emergency Procedures:
A diagram showing the emergency exits for level 7 is attached to this agreement.

The Host is to be briefed on emergency procedures by the Building Manager or representative or the Body Corporate at the time of signing this agreement.

Guests are to be advised by the Host of the emergency procedures for the building and given instructions on location of fire exits. In the event of an emergency phone 07 3838 9800.

General
Behaviour:
The Host is responsible for the behaviour of all guests whilst on Level 7 and at the Aurora premises. Guests are to be informed that Level 7 is also a residential floor and that residents are not to be disturbed.

Guests are to conduct themselves in an orderly fashion. Guests are not to interfere or disrupt residents using the gym, pool, spa, sauna or courtyard areas at any time.

Intoxicated people are to be monitored by the Host and escorted for safety purposes while on the premises.

Children under the age of 16 years must be accompanied by an adult.

Glass in any form is not permitted in the pool, spa or sauna areas.

There is to be no smoking in any area of level 7.

The Host is to take action to minimize the impact of noise, including the closing of balcony doors and reducing music volume.

The use of smoke machines or fireworks is strictly prohibited.

Items are not to be dropped or thrown over the sides of the building.

Functions that cause disruptions will be reported to the Body Corporate and these disruptions may jeopardize any future requests for functions by the Host.
Car Parking:
The Host is to ensure that all guests are advised of current parking arrangements. Guests may park in the designated Visitor's Parking section on Level 1 if vacancies exist.

All guests must report to the Aurora Reception on the ground floor to obtain a parking pass which must be shown on the dashboard/rear tray of their vehicle.

Failure to show a parking pass will result in the vehicle being towed. The current fee for towing vehicles is $350.00.

In addition, no vehicles may be parked in the laneways around Aurora. This will also result in the towing of the vehicle.

Cleaning:
The Host is responsible for cleaning the function area.

All benches and sinks are to be cleaned and the function area is to be vacuumed and mopped using the equipment of the Host.

Stains in carpet should be removed. If stains cannot be removed, a professional cleaning fee will be charged.

Toilets are to be checked and cleaned as appropriate otherwise a cleaning fee will be charged.

Hours of Access:
All functions, either in the lounge, lounge or theatre must be concluded and guests off the premises by 10.00 p.m.

This is in line with the general pool, spa and sauna areas which close at this time. Failure to comply will result in forfeiture of the deposit.

*The Body Corporate may negotiate other times as they see fit for the operation of the lounge, lounge and theatre.

Insurance:
The Body Corporate has Public Liability Insurance for all of Level 7.

Other Costs:
All costs for damage or the like incurred by the Body Corporate which can directly be attributed to the function or to a guest, will be passed on to the Host.

Should the pool or spa require draining due to glass being found within, then all costs associated with the draining, cleaning and refilling will be passed on to the Host.
Acknowledgement of Agreement:
The host acknowledges an understanding of the Fire and Emergency Evacuation Procedures and that the location of fire exits and fire equipment have been explained by the Building Manager or representative.

The Host of the function agrees to the Terms and Conditions regarding all aspects of conduct of the function outlined in this document.
